The Texas Real Estate Commission this month created a way for people to ask the commission to adopt or change a rule. Previously, there wasn’t a formal process.
People who want to request a rule be adopted, amended, or repealed can submit a written petition to TREC by one of the following ways:
- Email: general.counsel@trec.texas.gov
- Fax: 512-936-3788
- Mail: P.O. Box 12188, Austin, TX 78711-2188
- In person: Stephen F. Austin Building, 1700 N. Congress Ave., Suite 400, Austin, TX 78701.
Petitions must include the requestor’s name and contact information, a summary of the proposal, and any proposed language or amendments. Specific requirements can be found in 22 TAC §533.50.
The commission is required to consider all properly submitted petitions and either explain in writing why the proposal is being rejected or begin TREC’s process to propose the rule or change for adoption.
Not sure the correct way to suggest Form changes. One thing I’d like to see is another option on the TXR 1948 – ADDENDUM CONCERNING RIGHT TO TERMINATE DUE TO LENDER’S APPRAISAL, to state Buyer will pay $_______ over appraised value if appraisal is less than the contract price. The Partial Waiver could be used, but if appraisal is $1 less than the partial wavier amount, then it has to be re-negotiated.
